CORPORATE POLICIES Effective 6/1/2004 TERMS OF SALE / PAYMENTS All sales are paid in advance by check, cashier’s check, money order, credit card or wire. Credit and payment terms are not offered to domestic or international customers. All shipments will be made after the payment clears our bank. In the event a payment is not honored by the financial institution on which it is drawn the customer will be assessed a return check fee of $25.00 per occurrence. It is mutually understood Corporate Policies and Terms of Sale are accepted inclusively as a contract between Seller and Buyer when Buyer places an order online, written, verbally or accepts delivery of Sellers goods. LIMITED WARRANTY When properly used and applied according to all verbal and written recommendations, label directions, posted installation instructions and standard industry practices, the Aquapoxy Floor Coating System is warranted to adhere without peeling or experiencing hot tire pick up for 20 years in consumer residential applications, 10 years in commercial applications. Aquapoxy warrants The Aquapoxy Floor Coating System, and components listed below, are free from defects in material or workmanship. Additionally, Aquapoxy warrants these products, and components thereof, to resist the damaging effects of weather when used in residential consumer applications for 20 years, 10 years in commercial applications. The Seller makes no other warranty, express or implied, and all implied warranties of merchantability and fitness for a particular purpose are hereby disclaimed. Seller shall not be liable for prospective profits or special indirect or consequential damages. Seller’s sole liability and buyer’s exclusive remedy for breach of any warranty as expressly limited, at seller’s option, to replacement at the original F.O.B. point or refund of purchase price. Seller shall not be responsible for any claim resulting from failure to utilize product in the manner in which it was intended and in accordance with instruction provided for use of product. Application Instructions, Corporate Policies, Label Directions and Standard Industry Practices are made part of this warranty. Any claim for breach of warranty must be accompanied by a receipt and acceptable proof of product failure. Buyer shall give seller written notice of such claim allowing 30 days to allow seller reasonable opportunity to investigate claim and inspect product and application methods. The statements made on any of our literature, website or by any of our agents concerning our products, their potential applications or installation instructions are given for information purposes only. They are believed to be true and accurate and intended to provide a guide to approved construction practices and materials. As workmanship, product compatibility, weather conditions, application equipment, quality of other materials and other variables affecting results are beyond our control. Top Secret Coatings Inc. does not make nor does it authorize any agent or representative to make any warranty of MERCHANTABILITY OR fitness for any purpose or any other warranty, guaranty or representation, expressed or implied. Warranted items are hereby described as: TS-860, TS-870, TS-905, TS-910 & TS-920. © 6/2004 Top Secret Coatings Inc. 6/1/2004 COLORS Aquapoxy products are colored utilizing the Degussa 888 colorant system. Color matching services and Federal Spec 595 colors are available by request. For MT (Mass-Tint) colors utilizing the Degussa 888 or Federal 595 colorant system add $10 per gallon and $50 per five gallon container. For special order colors and color matches add $10.00 per container. Orders are carefully hand tinted but variations in color may occur so a color sample from each container is placed on the lid for customer approval. Once a container has been opened, applied, used or otherwise the color and contents of the container is considered accepted by the user. PRICING POLICY Aquapoxy reserves the right to change prices without notice. Prices to dealers are based on the full cases (standard packaging for standard coatings products 4 gallons per case). DAMAGES ORDER ERRORS & SHORTAGES It is the responsibility of the receiving party to inspect shipment for damage and accuracy. All order errors damage and shortages must be accompanied by supporting documents and invoice within thirty days. Shortages and damages must be noted on the carrier’s paperwork. When damage is discovered after packages are opened it is the responsibility of the receiver to file a claim with the carrier. Opened packages must be retained for inspection by a representative of the carrier. RETURNS, EXCHANGES & CANCELLATIONS Order changes and cancellations will not be accepted after the shipment has left our facility or while in transit. Order changes and cancellations must be made within 24 hours by calling 360-651-9050 9AM-4PM Monday to Friday PST. Refused shipments will be held in Will-Call for customer pick up. Reasonable storage will be charged after 30 days on all refused delivery shipments and after 90 days are subject to disposal without notice. All orders are colored on a per order basis therefore all sales are final on colored and tinted products. Returns and exchanges are not accepted on products colored to order. Stock merchandise may be returned or exchanged within thirty days. No returns or exchanges will be accepted without return authorization. All returns require an RTA (Return Authorization Number). Credits on approved returns are made F.O.B. shipping point, less a minimum 25% restocking charge. Returns, exchanges, order cancellations and product credits are not offered on batch, special order and non-stock items. SHIPPING Correct and timely shipments are our goal, however, we will not be held responsible for damages due to shipping delays, order errors or miss-shipments. Returns, credits and refunds will not be accepted on rush orders. Same day rush orders will be charged $25 per box. Small packages are typically shipped by Fedex or UPS Ground. Shipments by common carrier are prepaid or freight collect (F.O.B. origin). Aquapoxy will have the discretion of selecting the carrier. STANDARD PACKAGE SIZES Paint: 4 - gallons per carton, or five gallon containers. Pallets normally are loaded with 144 one gallon cans, or 20 five gallon containers.
